Splend BMW iX1 Promotion T&C's
The promoter of this promotion is Splend Pty Ltd (“Splend”). Subject to these Terms and Conditions, Splend will award one BMW ix1 to one of its customers at the conclusion of the Promotion Period (“Promotion”).
2. Eligibility
2.1. Entry is open only to:
Residents of Victoria;
Aged 23 years or older;
Customers who have signed up with Splend for the Flexi Ownership (FO) BMW iX1 plan during the Promotion Period (“Participants”).
2.2. Employees of the Promoter, its related entities, and their immediate families are ineligible to enter.
2.3. The Promotion is limited to a maximum of 30 Participants.
3. Promotion Period
The promotion commences at 12:01am AEDT on 01/12/2025 and ends at 11:59pm AEDT on 11/01/2026 (“Promotion Period”). Entries outside this period will not be accepted.
4. Entry Requirements
To participate, Participants must:
a) Sign up for the 4 or 5 year FO BMW iX1 plan at $524/$449 per week with Splend during the Promotion Period; and
b) Complete a minimum of 300 Eligible Trips during the Promotion Period (100 Eligible Trips in Week 1 and 200 Eligible Trips in Weeks 2 though to 6).
(“Eligible Participant/s”).
For the purposes of these Terms and Conditions, an Eligible Trip is a trip driven by the Eligible Participant, on Uber:
(a) during the Promotion Period; and
(b) within an 8 kilometre radius of the Royal Melbourne Golf Club (from 1 December 2025 to 7 December 2025) or Melbourne CBD (from 8 December 2025 to 11 January 2026).
5. Determination of Winner (Game of Skill)
5.1. The Eligible Participant who wins the Prize will be the Eligible Participant with the lowest Uber cancellation rate over the Promotion Period, as determined by Uber and notified to Splend (“Winner”).
5.3. In the event of a tie (identical Uber cancellation rate), the Eligible Participant who has completed the highest number of Eligible Trips during the Promotion Period will be deemed the Winner.
6. Prize
6.1. The Prize is ownership of one (1) BMW iX1 (“Vehicle”) vehicle (“Prize”).
6.2. The Prize is not transferable, exchangeable, or redeemable for cash.
6.3. The Promoter reserves the right to substitute the Prize with a vehicle of equal or greater value if necessary.
6.4. The Prize is the Vehicle only and Splend ownership benefits do not transfer. Splend will take all reasonable steps to terminate the Winner’s Flexi Ownership (FO) BMW iX1 plan within a reasonable period following transfer of the Vehicle into the name of the Winner.
7. Winner Notification and Claim
7.1. The Winner will be notified by phone and email within two (2) business days of the end of the Promotion Period and announced via Splend’s website and/or social media.
7.2. If the Winner cannot be contacted or does not claim the Prize within 14 days, the Promoter reserves the right to select the next highest-rated Eligible Participant as the Winner.
7.3 Within a reasonable time following successful contact with the Winner, Splend will arrange for the transfer of the Vehicle to the Winner and payment of stamp duty and any other registration transfer costs.
8. Verfication
8.1. The Promoter may request proof of identity, eligibility, trip completion records, and Uber rating verification.
8.2. Failure to provide verification to the Promoter’s satisfaction may result in disqualification and selection of an alternate winner.
9. General Conditions
9.1. The Promoter may disqualify any Participant who tampers with the entry process, breaches these Terms and Conditions, or acts in a fraudulent, disruptive manner or otherwise not in the spirit of competition, in its absolute discretion.
9.2. The Promoter’s decisions are final and binding.
9.3. The Promoter excludes, to the fullest extent permitted by law, any liability for loss, damage, or injury (including indirect or consequential loss) arising from participation in this promotion or acceptance of the Prize.
9.4. Personal information collected will be handled in accordance with Splend’s Privacy Policy at www.splend.com.
10. Legal Compliance
10.1. Splend reserves the right to modify, suspend, or terminate this Promotion or these Terms and Conditions at any time without prior notice.
10.2. Participants must comply with all applicable laws, Uber’s terms of service during the Promotion and any agreement between the Participant and Splend.
10.4. Participants agree to release, indemnify, and hold harmless Splend from any claims arising out of their participation in the Promotion and these Terms and Conditions.
10.5. These Terms Conditions and any dispute or claim arising out of, or in connection with it shall be governed by, and construed in accordance with, the laws of Victoria and then in accordance with the laws of the Commonwealth of Australia.
10.6. By participating in the Promotion, Participants acknowledge that they have read, understood, and agreed to these Terms and Conditions.
